# Commercial Appraisal for Litigation: What Connecticut Attorneys Need from an Expert Witness

When a commercial real estate valuation ends up in a courtroom, the standards change. A report that works for a lender's underwriting department may not survive cross-examination. An appraiser who can produce a defensible opinion on paper may not be the right person to defend it under oath. Litigation support is a specialty within commercial appraisal, and not every appraiser practices it — or should.

I've been retained as an expert witness and litigation support appraiser in cases involving eminent domain, partnership disputes, estate litigation, tax certiorari appeals, and commercial lease disputes. Here's what attorneys and property owners need to understand about the discipline — and what separates a report that holds up from one that doesn't.

## What Litigation Support Actually Means

Litigation support appraisal is not just a standard appraisal with a different intended use statement. The report has to be built from the ground up for adversarial scrutiny. That means the analysis is explicit — not just what the value conclusion is, but why every methodological choice was made, why particular comparables were selected and others weren't, why the income approach was weighted as it was.

When opposing counsel retains their own expert, the deposition will test exactly those choices. An appraiser who can't articulate the reasoning behind every adjustment, every selection, every reconciliation doesn't belong in that room. The report is only as good as the person who can defend it.

I approach every litigation assignment as if deposition is coming — because in active litigation, it usually is.

## Types of Cases That Require an Independent Commercial Appraisal

Attorneys in Connecticut regularly engage commercial appraisers for several distinct litigation contexts:

- **Eminent domain and condemnation.** When a municipality, state agency, or utility takes commercial property, the property owner is entitled to just compensation. The condemning authority's offer is backed by their own appraisal. An independent appraisal — one that examines highest and best use, severance damages, and the value of the remaining parcel — is how a property owner responds with evidence. The difference between a low offer and just compensation is frequently hundreds of thousands of dollars, and it lives in the competing appraisals.
- **Partnership and estate disputes.** When co-owners disagree on value, or when an estate requires a defensible date-of-death valuation, the appraisal becomes a document that may be scrutinized by opposing experts, probate courts, or the IRS. A standard appraisal written for a lender won't meet that standard.
- **Tax certiorari and assessment appeals.** Connecticut commercial property owners routinely challenge municipal assessments. The appeal rides on an independent appraisal of market value. I've prepared valuations for assessment appeals across the state — office, industrial, retail, and special-use — and argued them in front of boards of assessment appeals.
- **Commercial lease disputes.** Lease renewal clauses tied to fair market rent, co-tenancy violations, and percentage rent disputes all require defensible opinions of rental value. These are income-approach assignments with litigation stakes.

## What Attorneys Should Ask Before Engaging an Expert

Not every appraiser with a Certified General license is qualified to serve as an expert witness. Before retaining anyone, attorneys should press on a few specific questions:

- **Have you been deposed or testified in this type of case?** Deposition experience matters. An appraiser who has never had their methodology challenged under oath is an unknown quantity in that setting.
- **Have you been qualified as an expert in Connecticut courts or before administrative bodies?** Court qualification requirements vary; knowing an appraiser's track record in the venue matters.
- **How do you handle the methodology when the assignment conditions require retrospective value?** Date-of-death appraisals, condemnation valuations, and some lease disputes require valuing property as of a specific past date. That requires a different data set and a different approach than a current-as-of appraisal.
- **What is your familiarity with the subject property type and submarket?** An appraiser who primarily does residential work, or who doesn't work in the relevant Connecticut submarket, will be vulnerable on cross-examination to exactly these questions.

## The Connecticut Dimension

Connecticut litigation involving commercial real estate has its own texture. The state's unusually varied market — Fairfield County running on New York proximity, Hartford's insurance and government employment base, the industrial Naugatuck Valley, the eastern corridor around defense and gaming — means market area analysis is almost always an issue. An appraiser who doesn't know where one submarket ends and another begins will be exposed on that point by a competent expert witness on the other side.

I hold a Certified General Appraiser license and am an MAI candidate with active licenses in 11 states. My litigation work has included cases in federal court, state superior court, Connecticut probate court, and before municipal boards of assessment appeals. I approach every engagement with the expectation that the analysis will be scrutinized by someone who is actively looking for its weakest point.
